These Terms and Conditions explain in simple terms how I work on commissions: the process I follow, what each phase includes, how payments, revisions, usage rights, and basic communication guidelines work.
They are designed to protect both the client and me, ensure everything is clear from the start, and prevent misunderstandings during the commission. If you decide to work with me, please read them carefully and make sure you understand them before accepting a commission.
1. Definitions
• Artist: Me, the illustrator hired to create the artwork.
• Client: The person who commissions the illustration through VGen.
• Commission / Order: The work to be carried out: black and white sketch, revisions, and final colored version.
• Work Materials: sketches, digital files, drafts, PSDs, final versions, etc.
• Revision: changes or corrections that the Client may request at certain stages of the process.
• Final Delivery: the moment when I provide the Client with the colored artwork, including the allowed corrections.
2. Scope of Service
• The Client must clearly describe what they want (“brief”) before the work begins (characters, style, size, usage, etc.).
• I create a black and white sketch (line art) and send it to the Client for review.
• The sketch includes 2 rounds of revisions.
• Once the sketch is approved, I proceed with the colored illustration.
• The Client may request small color adjustments in the final version (tone, saturation, brightness, etc.).
• Structural changes, redraws, or major alterations are not included and require an additional quote.
3. Deadlines
• The final illustration will be delivered on the agreed date with the Client.
• If the Client delays in providing feedback or approval, those days will not count toward the delivery deadline.
• If any delay occurs on my part, I will inform the Client and we will renegotiate a reasonable new delivery date.
4. Payment
• A 50% deposit is required to start any commission.
• The remaining 50% is paid when the illustration is finished, before delivering the final files.
• If the Client cancels the commission after receiving the sketch, a cancellation fee (“kill fee”) will apply, resulting in the loss of the deposit or payment proportional to the work already completed.
• I will not deliver the final files until full payment is received.
• The payment method will be PayPal, unless otherwise agreed.
5. Intellectual Property and Usage Rights
• I, the Artist, retain all copyright over the illustration, sketches, and prior processes.
• The Client obtains a personal use license (for example: social media, wallpapers, profile pictures, personal printing).
• Commercial use, reproduction for profit, or transfer to third parties is not permitted without an additional agreement and payment.
• The final file will be delivered in PNG or JPG format in high quality. I never provide editable files (PSD, layers, etc.).
• I reserve the right to display the artwork in my portfolio, social media, or website, unless otherwise agreed.
6. Revisions
• The sketch includes 2 rounds of revisions.
• In the final stage, only small color corrections are allowed. Structural changes or redraws are not included.
• Additional revisions beyond what is agreed will incur an extra cost per change or per hour, as agreed.
7. Cancellations
• If the Client cancels before the sketch begins, the order may be fully canceled (minus possible transaction fees).
• If canceled after receiving the sketch, the Client must pay an amount proportional to the work completed (kill fee).
• If I need to cancel due to personal or health reasons, I will refund the proportional amount or agree on a new date with the Client.
8. Communication
• All instructions, corrections, or changes must be made in writing (via VGen, Discord, or email).
• If the Client does not respond within 7 days, an additional 7 days will be waited or until the order deadline, whichever comes first.
• If there is still no response after this period, the commission will be canceled without refunding the 50% deposit.
• If the Client demonstrates poor communication, requests changes outside the agreement, or behaves disrespectfully, I reserve the right to cancel the project, delivering only the proportional work completed.
• I also reserve the right to refuse any commission that I consider suspicious, inappropriate, or outside my policies.
9. Warranty and Liability
• I will perform my work professionally and to the best of my ability, but I do not guarantee that the illustration will exactly match the Client’s mental image, as art is subjective.
• I am not responsible for issues arising from inaccurate, low-quality references or insufficient information provided by the Client.
• The Client must ensure that all material or references they provide are legal and that they have permission or a license to use them.
• If the Client makes unauthorized use of the illustration (e.g., commercial use without a license), I reserve the right to claim compensation or take legal action.
10. Jurisdiction and Applicable Law
• These Terms are governed by Spanish law.
• In case of dispute, both parties agree that jurisdiction will correspond to my place of residence, unless otherwise agreed.
• VGen’s TOS apply in addition to these terms, but my specific conditions are also binding between the Client and myself.
11. Modification of Terms
• These Terms may be modified by me at any time.
• I will notify active clients of any significant changes.
12. Signature / Acceptance
• By confirming a commission, making the initial payment, or replying “I accept the TOS”, the Client declares that they have read, understood, and accepted these Terms.
